LIABILITY WAIVER

By our signatures below:

 

I acknowledge that this waiver and release of liability form will be used by the group, Pauly’s Party Bus LLC, and that it will govern my rights and responsibilities on the trip on which I am about to embark.

I acknowledge that the company is NOT responsible for my negligence or the negligence of other third parties, including, without limitation, negligent acts associated with consuming too much alcohol or other mind-altering substances.

 

I acknowledge that the company reserves the right to refuse service to me in its sole and absolute discretion if I engage in conduct detrimental to the safety of others and that I may be forced to make and pay for alternative travel arrangements in the event I am refused service by the company.

 

I acknowledge that the company is not liable in the event of a mechanical breakdown while on charter and will only be responsible for making up lost time at a mutually agreed date.

 

I WAIVE, RELEASE, AND DISCHARGE from any and all liability, including but not limited to, liability arising from negligence or fault of the company, for my death, disability, personal injury, property – damage, property theft, or actions of any kind which may hereafter occur to me unless such death, disability, damage, theft or injury is caused by the company’s gross negligence, recklessness, or intentional act.

 

This waiver and release of liability form shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law.
